Terms of Service

These Terms of Service (the “Terms”) govern your purchase and use of Asomium, a macOS desktop application (the “Software”), and the website asomium.com (the “Site”), both operated by Native First Beograd-Zemun, a sole proprietorship registered in the Republic of Serbia (registration number 68127254, tax ID 115136822), with its registered seat at Ivana Delnegra Engleza 42, 11080 Zemun, Belgrade, Serbia (“Native First”, “we”, “us”).

By purchasing a license, downloading, installing or using the Software, you agree to these Terms. If you do not agree, do not purchase, install or use the Software.

1. The Software

Asomium is a pre-made, downloadable native macOS application that helps developers manage their App Store Connect workflow — editing metadata across locales, generating screenshots, tracking keywords, viewing analytics, and uploading builds. The Software is sold “as is” as a finished product. We do not provide consulting, custom development, bespoke implementation, or any service offerings of any kind. All sales are of software licenses for the standard product.

2. Payments and Merchant of Record

All payments are processed by Lemon Squeezy (lemonsqueezy.com), which acts as the Merchant of Record (MoR) for every transaction. Lemon Squeezy collects payment from you, handles applicable sales taxes and VAT, and remits the net amount to Native First. Your receipt and billing statement will show Lemon Squeezy as the seller of record. By completing checkout, you also agree to Lemon Squeezy’s Terms of Service.

3. License Grant

Subject to your full payment of the applicable fees and your compliance with these Terms, Native First grants you a personal, worldwide, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on Mac computers that you own or control, for the duration of your active subscription or, for one-time licenses, in perpetuity (subject to Section 7).

Unless otherwise stated on the pricing page at the time of purchase, each license may be activated on up to three (3) Mac computers concurrently. You may deactivate a Mac from your account at any time and activate the license on another machine.

4. Subscription Plans, Renewal and Cancellation

Asomium is offered as a paid subscription with monthly and annual billing cycles, as listed on asomium.com/#pricing. Subscriptions renew automatically at the end of each billing period at the then-current price for that plan, charged to your chosen payment method via Lemon Squeezy, until you cancel.

You may cancel renewal at any time from your Lemon Squeezy customer portal or by contacting info@nativefirstapp.com. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date. Free trials, if offered, convert to a paid subscription at the end of the trial period unless cancelled before then.

5. Refunds

Our refund terms are described in our Refund Policy, which forms part of these Terms.

6. Acceptable Use

You agree not to, and not to permit any third party to:

• copy, modify, distribute, sell, sublicense or rent the Software;
• reverse engineer, decompile or disassemble the Software, except to the limited extent expressly permitted by applicable law;
• remove or alter any copyright, trademark or proprietary notices contained in the Software;
• share, resell, sublicense or otherwise transfer your license key to another person;
• use the Software to violate Apple’s App Store Connect terms, the App Store Review Guidelines, or any applicable law;
• use the Software to send spam, manipulate App Store rankings through unlawful means, or interfere with another party’s App Store presence.

You are solely responsible for the App Store Connect API keys, Anthropic API keys, and any other credentials you provide to the Software, for complying with the terms of those services, and for any content you publish to the App Store through the Software.

7. Termination

We may suspend or terminate your license without notice if you breach these Terms, attempt to circumvent the license activation system, charge back a legitimate payment, or use the Software unlawfully. On termination, your right to use the Software immediately ends and you must uninstall it from all your machines. Sections 6, 8, 9, 10 and 11 survive termination.

8. Intellectual Property

Native First and its licensors retain all right, title and interest in and to the Software, the Site, and all related intellectual property, including but not limited to source code, designs, trademarks, logos and documentation. These Terms do not grant you any rights to the Asomium or Native First names, logos or trademarks.

9. Disclaimer of Warranties

The Software is provided “as is” and “as available”, without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Software will meet your requirements, will be compatible with future versions of macOS, Xcode or App Store Connect, or that defects will be corrected within any particular timeframe.

10. Limitation of Liability

To the maximum extent permitted by law, Native First and its affiliates, directors, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, App Store rankings or developer-account status, arising out of or relating to your use of, or inability to use, the Software, even if we have been advised of the possibility of such damages. Our aggregate liability under these Terms will not exceed the greater of (a) the total amount you paid to Lemon Squeezy for the Software in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euro (€50).

11. Indemnification

You agree to indemnify and hold harmless Native First from any claim, loss or damage (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Software, or your violation of any third-party rights, including App Store Connect or Apple Developer Program terms.

12. Changes to the Software and these Terms

We may modify or discontinue features of the Software at any time. We may update these Terms; material changes will be announced on the Site and, where reasonable, by email. Continued use of the Software after the changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to its conflict-of-laws rules. The exclusive forum for any dispute that cannot be resolved informally is the competent court in Belgrade, Serbia. Nothing in this section limits any mandatory consumer rights you may have under the laws of your country of residence.
